Donald Trump wasted no time on day one of his presidency, managing to sign a flurry of executive orders amid all the pomp and circumstance of Inauguration Day. They deal with border security, January 6, TikTok, energy policy, birthright citizenship, and social issues (to name a few).
On the so-called ‘culture war’ front, the president previewed two actions he planned to take during his inaugural address to deal with DEI and radical gender ideology. Late Monday, he made it official, signing an executive order that recognizes two sexes: male and female.
Megyn called the order “beautiful” not just because of what it stands for, but for the way it was written. On Tuesday’s show, she broke down the specifics and explained why it is a win for all those who continue to fight for the protection of women and girls.
Sex vs. Gender
The executive action titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” was signed by Trump on Monday with the stated purpose to “defend women’s rights and protect freedom of conscience by using clear and accurate language and policies that recognize women are biologically female, and men are biologically male.”
“Across the country, ideologues who deny the biological reality of sex have increasingly used legal and other socially coercive means to permit men to self-identify as women and gain access to intimate single-sex spaces and activities designed for women, from women’s domestic abuse shelters to women’s workplace showers,” the order read. “This is wrong.”
As such, it is now “the policy of the United States to recognize two sexes, male and female.” The term ‘sex’ refers to “an individual’s immutable biological classification as either male or female” and is “not a synonym for and does not include the concept of ‘gender identity.'”
All federal agencies “shall use the term ‘sex’ and not ‘gender’ in all applicable federal policies and documents.” Trump administration officials confirmed this will include U.S. passports, visas, and Global Entry cards, which currently allow applicants to identify as “X.”
Protecting Women’s Spaces
Section four of the order specifically addresses “privacy in intimate spaces,” including women’s prisons, bathrooms, and locker rooms.
It calls for an end to men identifying as women being allowed in female-only detention centers and the use of federal dollars to fund so-called ‘gender affirming care’ for inmates. Additionally, “agencies shall effectuate this policy by taking appropriate action to ensure that intimate spaces designated for women, girls, or females (or for men, boys, or males) are designated by sex and not identity.”
While sports were not specifically mentioned in the order, Trump said at his pre-inaugural rally that he would take action to “keep all men out of women’s sports.”
‘It Is Perfection’
On X and on the show, Megyn called the executive order a work of art for how it lays out and addresses the issues at hand. “It is perfection,” she said. “We talk about this issue on the show a lot, and, in my wildest dreams, I couldn’t have drafted something this beautiful on this issue.”
Initially, she was unsure of who was responsible for crafting the measure but later learned it was May Mailman of the Independent Women’s Law Center and Stephen L. Miller, Trump’s deputy chief of staff for policy.
“After Joe Biden’s Title IX changes, we had very fierce women who have been standing up for women’s rights on our show, and May was one of them,” Megyn shared. “This is a no bullsh-t attorney who works for IWF… She wrote this thing along with beautiful editing, I’m told, by Stephen Miller.”
While Megyn noted that Miller is mostly known for his work on border policy, she called him “the magic behind the man” when she spoke after him at Trump’s rally on Sunday. “There is Trump, who’s got ideas, goals, and resolution to do something, but then he needs policy guys to actually write it up and enact it,” she said. “That is Stephen Miller, among other very talented people.”
Megyn’s takeaway: “Tip of the hat to May, to Stephen, and anybody else who worked on that thing of beauty.”
